Definition of Parties

The term "seller" will be used to describe Scenespot Design, LLC DBA MysticMats and any party related to the selling, distributing and/or manufacturing of our products/services.

The term "user" will be used to describe any individual, company, organization or party that does one or more of the following:

1.) Uses any website related to the seller.

2.) Makes a purchase of any product provided by the seller.

3.) Uses any product provided by the seller.

4.) Provides information to a seller owned website. 

The use of the word "Terms" will represent all Terms, Conditions and Policies listed on these pages.

Agreement to Terms

By making a purchase, transaction, providing information or using any of our sites, user acknowledges that they are agreeing to the listed Terms, Conditions & Policies ("Terms"). If they do not agree with all of these Terms, then they are expressly prohibited from using the site or our products, and must discontinue use immediately. Seller reserves the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason.

ARTWORK CONDITIONS

Seller is not responsible for any unauthorized use of logos and other elements. By making a purchase, user agrees that they have permission to use all artwork elements included on their product. Seller is not responsible for anything related to, but not limited to, IP violations, royalties, infringement and/or legal issues that may arise from element misusage. By submitting any content to the seller, user grants the seller a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any and all media formats. Users also represent and warrant that they have all necessary rights and permissions to grant this license to the seller. Seller refuses to produce any of the following artwork/elements that can be deemed: pornographic, fraudulent, obscene, immoral, infringing, illegal, blasphemous, or defamatory. These will be considered artwork violations. Violation decisions are at the sole discretion of the seller.

ARTWORK APPROVAL

User is responsible for (but not limited to) any typos, mistakes, misspellings and/or errors to the product design once their artwork is approved. All artwork is sent, by the seller, to the user for approval before the product is produced. No refund will be issued to the user if an artwork mistake is printed to a product that was approved by the user. User also understands that due to color limitations, printed colors will be matched as closely as possible and may appear different then their approved artwork proof. 

THIRD PARTY DATA

Seller's websites may use third party entities to perform specific functions to operate the websites. Seller assumes no responsibility for collection, use or misuse of data by said third parties.  

DISCLAIMER OF WARRANTIES 

THE SERVICE/PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SELLER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

LIMITATION OF LIABILITY

IN NO EVENT SHALL THE SELLER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE/PRODUCT, EVEN IF THE SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ASSUMPTION OF RISK

The user, on behalf of themselves, their personal representatives, families, heirs, executors, administrators, and next of kin, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the seller from any and all claims, demands, losses, or damages, including those resulting from the NEGLIGENCE (in whole or in part) of the seller, the users use of the product/service, or the operation of the product/service. This applies to all liability, claims, or actions for personal injury, property damage, or wrongful death, whether caused by the negligence of the seller or otherwise. 

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of laws provisions.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between the user and the seller with respect to the Service/Product and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

TERMINATION

Seller reserves the right, at our sole discretion, to suspend or terminate user account, password, or access to the Platform at any time, for any reason, and without prior notice. Seller may also discontinue the Platform, or any part of it, at any time. You acknowledge that if user access is terminated, seller may immediately delete user account and all related files. The seller shall not be liable to user or any third party for terminating user access. User only remedy for dissatisfaction with the Platform is to stop using it and close user account. 

SEVERABILITY

If any part of these Terms are found to be invalid, illegal, or unenforceable by a court, that specific provision will be modified to reflect the parties' original intent as closely as possible. All other parts of this Agreement will remain in full force and effect.

 SHIPPING POLICY

Seller uses a flat rate shipping system for all physical products. UPS and USPS are the only couriers we use for this system. Courier is decided by the seller and is dependent on availability, shipping price, shipping size/weight and users requested shipping location. Shipments can take up to 14 business days to arrive to the purchaser once dispatched. If the shipment is returned to sender due to incorrect customer information, user must pay for shipping to have it re-sent. All shipments going outside the continental United States will be shipped via UPS. Orders may be bundled together in custom packaging. User is responsible for the package(s) once the courier has marked it delivered or accepted. Seller are not responsible for products lost or damaged by the shipping carrier.

DAMAGE DISCLAIMER 

Seller is not responsible for any damage that occurs once the seller passes the products to the shipping carrier and/or user. This includes, but is not limited to, damage cause by maintenance, use, general wear and/or weather damage. Seller's maintenance suggestions are a recommendation, not a guarantee to prevent damage.  

REFUND POLICY

Users who believe they are entitled to a refund will need to send a request to info@mysticmatsusa.com for review. User must send this request within 5 days of receiving their product. This request must include photographic evidence and a description of the issue. Refund eligibility will be at the sole discretion of the user.

Scenespot Design, LLC DBA MysticMats operates this store and website, including all related information, content, features, tools, products and services, in order to provide the user, with a curated shopping experience (the "Services"). MysticMats is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose users personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of users personal information.

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction.
